Why Every Naples Trust Needs to Be Built to Last

A trust is meant to protect your family when they need it most, but it only works if it is drafted correctly, funded with everything it is meant to hold, and clear enough that your family never has to guess what you intended. Most trusts fall short on one of those three, and by the time anyone notices, it is often after you are gone, when your family is already grieving and has the least capacity to untangle a legal gap.

James R. Nici is a Naples trust attorney and a Florida Bar Board Certified Specialist in Wills, Trusts & Estates, one of fewer than 250 attorneys in Florida to hold that certification. He also holds an LL.M. in Taxation. That combination means your trust is built to hold up under both Florida trust law and the tax code, reviewed against your actual accounts and property. He serves families in Naples and Southwest Florida.

Your first consultation is free and lasts 30 minutes. Request a consultation to find out what your trust needs to actually do its job, whether you are starting from scratch or checking whether an existing trust still fits your life.

The Trusts Our Naples Trust Lawyer Builds for Families

Every family’s situation is different, and the right trust depends on what you own, who you are protecting, and what you want to avoid.

Our Naples trust lawyer builds:

  • Revocable living trusts, so your estate can move to your beneficiaries without a probate court filing
  • Irrevocable trusts, structured to protect assets for your beneficiaries from future claims
  • Charitable trusts, for families who want part of their legacy to support causes they care about
  • Blended family trusts, so children from a prior marriage and a current spouse are both provided for as intended
  • Vacation and seasonal home trusts, so a property that has stayed in the family for generations does not get pulled into probate in two states

Each trust is drafted around your assets and your family, not a template pulled off a shelf, and we review the plan with you again whenever a major life change makes an update worth considering.

A Clearer Plan for Your Family’s Future

What Happens When a Trust Is Drafted but Never Funded

A trust that is signed but never funded protects nothing. If your home, investment accounts, or vacation property are still titled in your own name when you pass away, they go through probate the same way they would without a trust at all. The Florida Trust Code, Fla. Stat. ch. 736, sets out how a trust must be created, funded, and administered, and a trust that skips the funding step does not do the job it was built for.

Creditor protection works the same way. Under Fla. Stat. § 736.0505, a revocable trust’s assets stay open to your creditors during your lifetime. An irrevocable trust created for your beneficiaries can protect assets from future claims once it is properly structured and funded, but a trust you create for your own benefit generally does not shield those assets from your own creditors.

Which structure fits your situation depends on what you are protecting against, whether that is a future lawsuit, a family member’s creditors, or simply keeping your estate private, and getting that decision right the first time is worth far more than fixing it later.

This reflects Florida law as of September 2026.

Estate Planning Designed Around Your Life

Keeping Your Estate Out of Probate Court

Collier County’s probate division is where an improperly funded trust, or no trust at all, sends your family after you are gone.

A trust that is properly funded generally keeps your estate out of probate court, avoiding the months of filings, notices, and court supervision that a Florida probate case usually involves.

Naples also has a large population of seasonal residents, and that adds a wrinkle a full-time Florida resident never faces. If your legal domicile is not clearly established here, your trust can still get pulled into a second probate proceeding in the state you split time with, even after everything in Florida was handled correctly.

A Florida Bar Board Certified Specialist in Wills, Trusts & Estates, James R. Nici built the Strategic Estate Planning System® to keep your trust funded and your family out of court. He brings that approach to families in Naples and across Southwest Florida.

Deeds that fund your trust for Collier County property are recorded by the Collier County Clerk of the Circuit Court, so we prepare each transfer to meet its recording requirements.

What Our Clients Say

Naples Trust Lawyer Questions We Hear Most

Is the first consultation free?

Yes. Your first consultation with our trust lawyer is free and lasts 30 minutes. We talk through your family, your assets, and what you want your trust to do.

What happens during the consultation?

We learn about your family and goals, explain what Florida law requires, and outline the trust and related documents you need. If you move forward, our attorney drafts a trust built around your assets and your family.

Do I need a trust if I already have a will?

A will and a trust do different jobs. A will only takes effect through probate, while a trust can move assets to your beneficiaries without court involvement at all. Most Naples families use both: a trust for the bulk of their estate, and a will to catch anything left outside it.

I split my time between Naples and another state. Which state’s law applies to my trust?

Your trust generally follows the law named in the trust document itself, but your domicile, where you are legally considered a permanent resident, still affects your estate taxes, homestead protection, and probate exposure. We review both together so nothing falls through the cracks.

Who should I name as trustee?

Your trustee should be organized, level headed under pressure, and willing to serve, whether that is a family member, a trusted friend, or a professional fiduciary. We walk through the tradeoffs of each option based on your family’s actual situation, including what happens if your first choice is unable or unwilling to serve when the time comes.

How much does it cost to set up a trust in Naples?

Cost depends on the complexity of your estate, the number of trusts and related documents involved, and whether tax or asset protection planning is part of the plan. After your free consultation, we give you a clear, upfront number before any work begins, so there are no surprises later.

If your question is not listed here, that is what your free consultation is for.
